Street Art -- Lost Values


This mural seems to capture everything that is wrong with street art and its lost values.

At face value, this is a mural painted by Kai Aspire. The piece is entitled 'Lost Values', and it is re-assigning Louis Vuitton's 'LV' to mean 'Lost Values'.

At face value, it is pretty weak. The art is lame. The message doesn't say anything. And why any street art piece would be talking about 'lost values' in the uber-rich fashion world is a stretch to say the least. Louis Vuitton and street art? What do they have in common? Nothing but lost values and poor artists.

But even though it wasn't intended, this piece works perfectly on a deeper level. Like we say in the opening sentence, this mural seems to capture everything that is wrong with street art and its lost values.

Kai Aspire is not just another street artist. Kai was born with a silver paint brush in his hand. Kai is the nephew of Mr. Brainwash, and Kai's father owns this wall where the mural was painted. In fact, years ago, this wall used to be organic street art. Meaning that art just used to pop up on this wall on its own. Then, 3 years ago, the Guetta family started curating this wall. The best part is that the art did keep changing with constantly rotating murals, but the worst part is that the move transitioned this wall from 'street art' to 'public art'.  Strike one.

Strike 2 is the focus of the content itself. Like we say, street art and fine fashion have nothing in common. And any street artist thinks that fashion empires like 'Louis Vuitton' demonstrate 'lost values', well, then the artist is the one with the lost values. Like here. Street art should pack a message worthy of the streets. Not just this piece, but street art in Los Angeles in general seems to be failing to spread a worthy message.

Strike 3 is to pretend to be something you're not. And since Warhol, their has been a movement in the art world that says a factory is okay--the factory concept is the idea that the artist does not have to paint every stroke, someone else can do the work and yet the art is still considered an original. Okay, fine. We understand the factory concept. But what Kai is doing seems beyond the scope of Warhol's factory. You see, Kai paints murals like this one, and the one pictured below. Actually, the one pictured below provides the perfect example of what Kai did and didn't do. Kai did paint his name on the right. You can see from the thick brush strokes and uncontrolled drips how Kai literally has no skill with the brush. And now, compare that to the image next to Kai's signature. It is a masterfully blended image of Kanye West dressed up in medieval clothing. The art skill is seriously stunning, but it is clear that the image was not painted by Kai. The image on the wall was actually wheat pasted, but it is an enlarged image of a painting that Kai attempted to sell at a previous art show, as his own work. What!? A lot of folks in the community were outraged at Kai's first show because he did not paint the art that he was selling. Forget the factory concept, when did it become anything other than fraud to pretend something you didn't make, is yours? Talk about lost values . . .

Okay. So this mural has technically already struck out. But there are still more egregious things wrong with it. Basically, and 'technically' this entire mural is not even 'art'. This is an advertisement. In fact, if you were to take this mural and shrink it down into postcard size, then this would be a flyer for Kai's show. It is not art because the information on the flyer tells the viewer where to buy what the artist is selling. The viewer is not allowed to interpret the image or message, when it is done this way the viewer is instructed where to 'shop'. Like we say, this is not art, this is a painted advertisement.  For an art show with paintings that the artist did not paint focusing on issues that are irrelevant to life and the streets.

Finally, the only time Kai does anything on the streets is right before he is about to have an art show. As M&F has said before, the streets are not a platform to a gallery. The streets are the real prize. And if you only put up a handful of street pieces in order to hype a gallery show, well, that is not really a street artist. Don't know exactly where to draw the line, but that is not a street artist at all. That's someone trying to use the streets for advertisements. Not street art, an insult to the streets.

Street art needs to dump some baggage, get back into touch with what its about, and remedy these 'lost values'.

This piece is one of the early MBW's.  It was placed up on the streets when Banksy told Brainwash to "do art".

The art might have changed but this spot on Melrose still looks the same!

Mr. Brainwash Loses Another Lawsuit


Mr. Brainwash has just finished another court battle regarding his use of stenciled images from photographs in his street art and gallery work--and Mr. Brainwash lost again.

The first one centered around Brainwash's use of an iconic Run DMC photo. This latest case is based around MBW's being sued for using a classic photo of Sid Vicious taken by Dennis Morris.  MBW is accused of using it without permission.

A federal judge ruled that while MBW's artwork does add some "new elements" to the original pieces, however, the new elements did not change it enough.   The judge said that "the overall effect is not transformative".

This type of evaluation can be a double-edged sword, as demonstrated by the recent case of LA street artist Euthanasia against Green Day.  Green Day had used a gently modified version of one of Euth's images as a back drop for their North American Concert tour years ago, without ever getting permission from Euth.  Euth lost his case when a federal judge tossed it out after Euth testified that putting a red cross on the image (what Green Day did), "maliciously devalues the original intent".  But that, the judge said, made it transformative, so Euth lost the case.

The judge also rejected Brainwash's argument that 'appropriation art per se' should be protected by fair use.  The terms of the settlement and damages from this case have not yet been determined.

This case might have a big impact on the world of street art, since so many artists use iconic photos celebrity photos in their art work.  It seems like when it comes to an original image, you can't use it unless you ruin it?  Then its okay?

Stolen Imagery



A story has been developing in Los Angeles where a store called HD Buttercup has enlarged a photo print of a street piece from Thank You X, and is now selling this print in the store for $3,000 (pictured above).

Thank You X says that he never gave the store permission to use the image, or sell it.  He is not pleased and X's lawyer has sent a cease-and-desist letter to the store to stop selling it.

There is not doubt that the image HD Buttercup is selling is the same shot as one that X stenciled on a dumpster (see pic below).  However, this situation is further complicated by the fact that the image at hand is a stencil picture of Andy Warhol.  It is based on an iconic photograph of Andy Warhol (not sure who took the original?).  Thank You X says that he drew a hand painted piece based upon the original photograph image and that his image is trademarked, but X does not have intellectual rights to the original image in the first place.

This situation has a lot of similarities to the case last year when Mr. Brainwash got sued by Glen E. Friedman when MBW used Friedman's iconic Run DMC photograph in an art piece without permission.  MBW lost the lawsuit because the judge ruled that Brainwash did not change the image enough.

So what's the moral of the story?  Its fucked up when any store appropriates imagery from any artist without permission and/or compensation.  As his lawyer advises him, if X were to sue the store, he would probably win.  However, if the original photographer chose to sue X, they might also probably win.  Perhaps, the moral of the story might be that if an artist want's to protect the intellectual property rights of their art, the way to do that is to create original art.  Pop imagery is a favorite to employ among street artists.  Because even though that image might be iconic,  that recognition also comes loaded with previous baggage.

This pic is of the Mr. Brainwash art installation at the Seth McFarlane Oscars after party.

Andre the Giant has had his neck slashed and some unholy markings added to his body.

Thanks to Muzzle Flash for the exclusive pictures, and Muzzle says that he thinks this vandalism is likely aimed at Shepard Fairey/MBW and might be the work of "Cuttahotha, I recognized the inverted cross and black/pink combo.. he goes old school vandal style, normally targets institutions of consumption.. "

Including a Darth Vader and Yoda made of tire rubber that look like they belong in some half ass miniature golf course outside of Minot, North Dakota.

Ouch.  But that Vader is looking rough. . .

This mural is one of, if not the only, mural from Mr. Brainwash that is still riding in Los Angeles with his old school style of celebrity stencil.  This is prior what we will call MBW's 'Love Phase'.

Old Brainwash Building Gets Bombed!


The building where Mr. Brainwash hosted his 'Art Show 2011' has remained a hot bed for art even after the exhibition has closed.

Mr. Brainwash might have invited street artists of all ages, types, and skill levels to participate in the show, but graffiti writers don't need an invitation.  The building is completely bombed out, especially the windows.  This is at a busy city intersection, so any piece on this building scores extra points for being at a hot location.
